1. Agreement to Terms

By accessing or using the RPM (Smart Attendance Management) application, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this application.

2. Use License

RPM grants you a limited, non-exclusive, non-transferable license to use the application for attendance management purposes in accordance with these Terms. This license does not include:

  • Modifying or copying the application materials
  • Using the materials for any commercial purpose without authorization
  • Attempting to reverse engineer any software contained in the application
  • Removing any copyright or proprietary notations from the materials

3. User Accounts and Responsibilities

3.1 Account Registration

To use RPM, you must register an account provided by your organization's administrator. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Facial Recognition Data

By registering your face for attendance verification, you consent to the collection, storage, and processing of your facial biometric data as described in our Privacy Policy. You have the right to withdraw this consent at any time by contacting your organization's administrator.

3.3 Prohibited Activities

You agree not to:

  • Submit attendance on behalf of another person (buddy punching)
  • Tamper with or manipulate the Bluetooth communication system
  • Use fraudulent images or photos for attendance verification
  • Interfere with the proper functioning of the application
  • Access or attempt to access other users' accounts or data

4. Data Collection and Privacy

RPM collects and processes personal data including but not limited to:

  • Employee identification information
  • Facial biometric data for recognition purposes
  • Attendance records (check-in/check-out timestamps)
  • Device information and Bluetooth connectivity data
  • Location data when submitting attendance

5. Service Availability

While we strive to provide continuous service availability, RPM does not guarantee uninterrupted access to the application. We reserve the right to modify, suspend, or discontinue the service at any time without prior notice for maintenance, updates, or other operational reasons.

6. Security

We implement industry-standard security measures to protect your data, including:

  • Encrypted data transmission (HTTPS)
  • Secure token-based authentication (JWT)
  • Encrypted local storage for sensitive credentials
  • Regular security updates and patches

However, no method of electronic storage or transmission is 100% secure. You are responsible for protecting your account credentials and notifying your administrator immediately of any unauthorized access.

7. Intellectual Property

The RPM application, including its original content, features, and functionality, is owned by RPM and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, RPM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from:

  • Your use or inability to use the service
  • Unauthorized access to or alteration of your data
  • Any other matter relating to the service

9. Indemnification

You agree to indemnify and hold harmless RPM and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the application or violation of these Terms.

10. Platform-Specific Terms

10.1 Android Devices

The RPM application for Android requires certain permissions to function properly, including camera access, Bluetooth connectivity, and storage access. By installing the application, you grant these permissions as requested.

10.2 iOS Limitations

Due to iOS platform restrictions on Bluetooth Classic communication, full functionality of RPM is currently only available on Android devices. iOS support may be limited to alternative communication methods.

11. Modifications to Terms

RPM reserves the right to modify these Terms of Service at any time. We will notify users of any material changes by updating the 'Last Updated' date at the top of this document. Your continued use of the application after such modifications constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which your organization operates, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and RPM regarding the use of the application and supersede all prior agreements and understandings.

By using RPM, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
